This website, canpaigns.com (the "Platform"), is owned, managed, and operated by Capital Securities LLC (referred to as "We," "Us," "Our," or "Company"). Capital Securities LLC is a Wyoming registered limited liability company.
Canpaigns is a software-as-a-service (SaaS) platform that allows you ("Customer" or "User") to manage contact lists and send text messages (SMS) to your own opted-in contacts and supporters. The service is intended to help political campaigns, organizations, and individuals communicate directly with audiences who have chosen to receive such messages.
You are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account. You must provide accurate, current, and complete information during registration and update it as needed. We reserve the right to suspend or terminate accounts that violate these terms.
By using the Canpaigns platform to send SMS messages, you represent and warrant that all recipients of your messages have affirmatively opted in to receive text messages from you. You are solely responsible for obtaining and maintaining valid, documented consent from all message recipients. Recipients may opt out of receiving messages at any time by replying "STOP" to any message. Standard carrier messaging and data rates may apply to recipients. You agree to comply with all applicable federal, state, and local regulations governing SMS messaging, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines.
We do not sell, share, or buy consumer data or opted-in contact information with third parties or affiliates for marketing purposes. Your contact lists remain your property and are processed on your behalf as a service provider. We use this data solely to deliver the messaging services you request.
You agree not to use the Canpaigns platform for: (1) sending messages to purchased, rented, or borrowed contact lists without proper individual consent from each recipient; (2) third-party lead generation, affiliate marketing, or commercial list distribution; (3) harassment, spam, fraud, or any illegal activity; (4) violating TCPA compliance requirements or CTIA guidelines. Violations may result in immediate account suspension and termination.
Fees for the Canpaigns service are based on your chosen pricing plan. All fees must be paid in advance. Billing occurs monthly unless otherwise specified in your subscription agreement. We accept credit and debit cards for payment via Stripe. You authorize us to charge your payment method for the fees due. Failed payments may result in service suspension.
Either party may terminate this service at any time. Upon termination, your account access will be disabled and your data will be retained according to our data retention policy. Termination does not relieve you of outstanding payment obligations.
The Platform is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or free from viruses. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to lost profits or data loss.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions, and shall apply to all users throughout the United States.
We may update these Terms and Conditions at any time. Changes will be effective upon posting to the Platform. Your continued use of Canpaigns following the posting of revised Terms means that you accept and agree to the changes.
